Lightower Official Customer Sweepstakes Rules

Please read these Official Rules (“Official Rules”) of the Lightower Customer Sweepstakes (the “Sweepstakes”).  You must agree to accept and comply with these Official Rules to participate in the Sweepstakes.   NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON.

  1. Sweepstakes Sponsor:  LTS Buyer LLC, d/b/a Lightower Fiber Networks (the “Sponsor”), a Delaware limited liability company, whose principal address is 80 Central Street, Boxborough, MA 01719.
  2. Timing:  The Sweepstakes launch date is expected to be on or about April 13, 2016 and will end on April 27, 2016 (“The Sweepstakes Period”).    A Sweepstakes may only be entered during the relevant Sweepstakes Period.  Sweepstakes launch and final end dates are subject to change and are solely determined by the Sponsor.
  3. Who Can Enter:   The Sweepstakes is only open to existing customers of the Sponsor or its subsidiaries as of the Sweepstakes Period.  The Sponsor will email out an online survey invitation directly to current customers that deal with, work with and/or have direct interactions with the Sponsor regarding the services supplied by the Sponsor for the existing customers’ organization (“Eligible Sweepstakes Respondents”).
    1. Eligible Sweepstakes Respondents must be legal residents of the United States or Washington, D.C. (excluding Alaska, Hawaii, Louisiana, Rhode Island, Puerto Rico, U.S. Virgin Islands and Guam) and must be at least 18 years old at time of entry.
    2. Any individuals (including but not limited to employees, consultants, independent contractors and interns) who have held employment with or performed services for Sponsor or any organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Sweepstakes are not eligible to become Eligible Sweepstakes Respondents, enter or win.
    3. Immediate family and household members of such individuals are also not eligible to become Eligible Sweepstakes Respondents, enter or win.
    4. “Household Members” shall mean those people who share the same residence at least three months a year. “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses.
  4. HOW TO ENTER:  There are two ways to enter the Sweepstakes, which are  a) online method and b) mail-in method
    1.  Online Method
      1. To enter the Sweepstakes via the online method, you must have directly received an email from the Sponsor with a link to this specific Sweepstakes (either or (or some derivation of these two URL links as solely determined by the Sponsor).   
      2. All Internet access and usage charges are your sole responsibility. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any Sweepstakes entries submitted pursuant to this paragraph 4(a).
      3. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network/lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestions on the Internet or at any website, or any combination thereof, including any injury or damage to your or any other person’s computer-related to or resulting from participation or downloading any materials in the Sweepstakes.  Any such entries shall be deemed invalid and ineligible for purposes of the Sweepstakes.  
      4. Entries generated by robots or scripts or other automated devices will be deemed to be a violation of these Official Rules, and any such entries shall be deemed invalid and ineligible for purposes of the Sweepstakes.
    2. Mail-in Method
      1.  As an alternative to the online method of entry described in paragraph 4(a) above, you may enter the Sweepstakes by printing your name, age, complete street/mailing address (including zip code), phone number (including area code), email, the relevant survey deadline on a 3½” x 5” card, and mailing the completed card, with sufficient first-class postage affixed, to Lightower Fiber Networks, Attn: Marketing Department – Joanne Hynes Customer Survey Sweepstakes, 80 Central Street, Boxborough, MA 01719.  Such mail-in entries for the Sweepstakes must be legible, and submitted in original hand-printed form. A mail-in entry pursuant to this paragraph 4(b) will be deemed valid and eligible for consideration only if such entry has a postmark date prior to the end of the relevant Sweepstakes Period and if such entry meets all eligibility requirements detailed under paragraph (3) above.
      2. The Sponsor is not responsible for any lost, late, misdirected, postage due, damaged, mutilated, illegible, indecipherable, incomplete, inaccurate or deceptive Sweepstakes entries, all of which shall be deemed invalid and ineligible for purposes of the Sweepstakes.
  5. LIMIT: Only ONE ENTRY per Eligible Sweepstakes Respondent is permitted per completed survey during a Sweepstakes Period.
    1. In the event that more than one entry is received with respect to any Eligible Sweepstakes Respondent, the first entry processed by the Sponsor will be considered the only valid entry.   
    2. All entries and materials submitted become the property of the Sponsor and shall not be acknowledged or returned.
    3. If entries exceed the entry limitations, the Entrant may be disqualified in the Sponsor’s sole discretion.
    4. Entrants must provide all information requested to be eligible to win.  Incomplete, unreadable, or unintelligible entries shall be immediately disqualified.
    5. Each entrant must be the rightful owner or have authorized use of the e-mail address identified in the entrant’s entry as of the Sweepstakes Period.
    6. In the event of a dispute as to the identity of a winner, the winner shall be deemed to be the person in whose name the e-mail account governing the e-mail address was opened.
  6.  What are the Prizes? 
    1. Total approximate retail value (“ARV”) of all prizes awarded is $1,075.
    2. The first fifty (50) Eligible Sweepstakes Respondents to complete and submit the survey will receive a $10 Amazon online gift card, while supplies last.   Amazon is not a sponsor, affiliated with or a participant in the Sweepstakes.
      1. These 50 Amazon online gift cards will be delivered electronically directly to the email addresses provided by Eligible Sweepstakes Respondents on the Sweepstakes form or on the 3½” x 5” card outlined in paragraph (4) above.   
    3. All Eligible Sweepstakes Respondents will be included in a random drawing for the following prizes (“Prizes”) :
      1. One (1) Apple iPad:  ARV of $500
      2. One (1) Backpack:  ARV of $35
      3. One (1) Quarter Zip Long Sleeved Pullover:  ARV of $40
        1. How will the Prize Winners be Determined?   Any customers that received a direct email from the Sponsor regarding this Sweepstakes meet all eligibility requirements pursuant to paragraph (3), subsequently fully complete all questions, and then submit the survey within the Sweepstakes Period will be combined with the eligible mail-in Sweepstakes entries received by Sponsor pursuant to paragraph 4(b), in order to create the entry pool for the Grand Prizes for the Sweepstakes (“The Entry Pool”).
        2. Within 30 days, or on some other date (as determined by the Sponsor in its sole discretion) (the “Prizes Drawing Date”) following the conclusion of the Sweepstakes Period, the potential recipients of the Prizes (the “Prize Recipients”) will be selected by means of a random drawing conducted by the Sponsor or its designee from among all eligible entries contained in the Entry Pool.
        3. All decisions of the Sponsor or its designee regarding the Prizes drawing and any and all other aspects of the Sweepstakes shall be final, binding and non-appealable.
        4. Your odds of receiving one of the Prizes (or any other prizes awarded hereunder) will be determined by the total number of Eligible Sweepstakes Respondents.
  7. How will the Prize Recipients be notified? Shortly after the Prizes Drawing Date drawing described in Paragraph 6(b) above, the Sponsor shall endeavor to notify the Grand Prize Recipients by e-mail or by telephone, as directly provided to Sponsor by the last question of the Sweepstakes or information on the mail-in entry.
    1. The notice method used will be at Sponsor’s discretion.
    2. If the Prize Recipients fail to respond to the Sponsor within three (3) days after being notified by the Sponsor, or if such notification or the Prize itself is returned as undelivered, then the Prize Recipients are deemed to have forfeited any and all rights to receive the Prize, and the Sponsor may elect to (but shall not be required to) select an alternate Prize Recipient by means of another random drawing pursuant to the procedure described in paragraph 6 above from among the remaining Eligible Sweepstakes Respondents.
    3. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or notice to be received by the Prize Recipient on account of technical problems or traffic congestions on the Internet or at any website or telephone network or lines, or any combination thereof.
  8. How Can I Find Out Information About Who Won the Prize? To obtain the name and the city or town of residence of the Grand Prize Recipients (available after the Prize Drawing Date), you should send a self-addressed stamped business size envelope, to Lightower Fiber Networks, Attn: Joanne Hynes Marketing Department-Customer Survey Sweepstakes, 80 Central Street, Boxborough, MA 01719.
  9. Ownership of Sweepstakes Materials. Your Sweepstakes entry, together with any and all accompanying or other Sweepstakes-related materials submitted by you, shall become the exclusive property of the Sponsor and will neither be acknowledged nor returned.
  10. Proof of Identity and Affidavit. If you are a Prize Recipient, you may be required to:
    1. furnish photographic identification in the form of a government issued document; and
    2. furnish a signed affidavit or such other documentation
      1. acknowledging your acceptance and compliance with these Official Rules,
      2. confirming your eligibility to participate in the Sweepstakes, and
      3. provide the Sponsor any other reasonably requested information, including, without limitation, your social security number and any other information required for tax reporting purposes, in a form determined by the Sponsor.
    3. Failure to furnish such information and signed affidavit within the time period stated in the Sponsor’s request may cause disqualification.
  11. Consent to Use Name and other Information. To the fullest extent consistent with applicable law, the Prize Recipients  hereby specifically grant permission to Sponsor to provide his/her name and the city or town of residence to any person who requests such information pursuant to Section 10 of these Official Rules, without any obligation on the part of Sponsor
    1. to pay any additional compensation (of any kind or amount) to such Prize Recipients, or
    2. to seek or obtain the approval of such Prize Recipients.
  12. Agreement to the Official Rules. By participating in the Sweepstakes, you fully and unconditionally agree to accept these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes.
  13. Governing Law. These Official Rules and any disputes relating thereto are governed by and shall be construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to any choice or conflict of law provision or rule that would cause the application of the laws of any other jurisdiction other than the laws of the Commonwealth of Massachusetts. THE SWEEPSTAKES ARE VOID WHEREVER PROHIBITED BY LAW.
  14. Release. You hereby release the Sponsor, its parent companies, subsidiaries and other affiliates, and their respective directors, officers, managers, members, partners, agents, employees and representatives from any and all claims, costs, injuries, losses or damages of any kind caused by your participation in the Sweepstakes.
  15. Taxes. All federal, state, and other tax liabilities arising from the Sweepstakes are the sole responsibility of the Prize Recipient.
  16. Disputes. You expressly agree, irrevocably and in perpetuity, that (a) any and all disputes, claims, actions and causes of actions arising out of or in connection with the Sweepstakes, or any prize awarded hereunder, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall be brought and shall take place exclusively in a federal or state court located in the Commonwealth of Massachusetts; your agreement to submit to the exclusive jurisdiction and venue of such courts, (b) any and all claims, judgments, damages, and awards shall be limited strictly to actual out-of-pocket costs actually incurred by you and paid to a third party, including costs associated with entering the Sweepstakes, but excluding attorneys’ fees, and (c) under no circumstances shall you be permitted to obtain awards for, and you hereby waive any and all rights to claim, punitive, exemplary, special, consequential, incidental, indirect and/or other damages, other than for actual out-of-pocket expenses actually incurred by you and paid to a third party.
